Global Terms of Service

These Terms of Service ("Terms") govern the use of the services provided by the operator ("Service"), including but not limited to websites, applications, APIs, and related functionalities, regardless of name or form.

1. Operator's Discretion

The operator may revise these Terms, service rules, specifications, or pricing at any time, and such changes shall take effect immediately upon publication.

2. Account Suspension and Termination

The operator may suspend or terminate accounts, revoke access, or restrict features at any time for any reason or no reason, with or without notice.

The operator is not obligated to provide refunds or compensation due to suspension or termination, except where required by applicable law.

3. Age Requirement and Legal Responsibility

The Service may contain adult-oriented expressions or content.

Only individuals who are at least 18 years of age (or the age of majority in their jurisdiction) may access or use the Service.

Users are solely responsible for ensuring that their access to and use of the Service complies with all applicable laws, regulations, age requirements, and third-party rights in their jurisdiction.

4. Prohibited Conduct

Users shall not engage in conduct including, but not limited to:

  • Violations of applicable laws or regulations
  • Criminal acts or acts facilitating criminal activity
  • Infringement of third-party rights (copyrights, trademarks, privacy, reputation, etc.)
  • Unauthorized access, reverse engineering, scraping, or actions imposing excessive load
  • Harassment, defamation, threats, or obstruction of the Service or third parties
  • Any conduct deemed inappropriate by the operator in light of the Service's purpose
5. Content and Intellectual Property

All rights related to the Service belong to the operator or legitimate rights holders.

Users grant the operator a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use user-submitted content (including text, images, audio, prompts, logs, and similar data) for purposes including reproduction, modification, publication, distribution, and analysis, including machine learning.

The operator has no obligation to store or display user content and may delete it at any time.

6. Content Removal and Availability

The operator may remove, restrict, or disable access to any content at any time, with or without notice, for any reason. The operator makes no guarantee that any content will remain available.

7. Disclaimer

The Service is provided "as is" without warranties of any kind, including accuracy, safety, completeness, fitness for a particular purpose, or continuity.

Outputs generated by the Service, including AI-generated outputs, are provided for reference only. Users assume all responsibility for their use.

The operator shall not be responsible for disputes between users or between users and third parties.

8. Limitation of Liability

To the extent permitted by law, the operator's liability shall be limited to direct and ordinary damages only.

In no event shall the operator be liable for indirect, incidental, special, consequential, or lost-profit damages, data loss, or loss of opportunity.

The operator's total cumulative liability shall not exceed the total amount actually paid by the user to the operator during the three (3) months preceding the event giving rise to the claim (or zero if no payment was made).

9. Data and Logs

The operator may collect and use access logs and related data for service operation, improvement, security, fraud prevention, and quality control.

The operator does not guarantee backup or data preservation and may delete data as necessary.

10. Anti-Social Forces

Users represent and warrant that they are not members of anti-social forces and have no association with such entities.

The operator may suspend or terminate access without notice if a violation is suspected.

11. Governing Framework

These Terms shall be governed and interpreted in accordance with applicable laws as determined by the operator.

Any disputes arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of a court designated by the operator.

12. Severability

If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.

Japan Addendum

This addendum applies only to users accessing the Service from Japan as special provisions subordinate to the Global Terms of Service.

If any conflict arises between the Global Terms of Service and this addendum, this addendum shall prevail only for users accessing the Service from Japan.

1. Recognition of Adult-Oriented Expression

The Service may include content that contains sexual expression.

Users in Japan shall access the Service with an understanding that such expressions require careful social and legal handling.

2. Viewing Restrictions in Japan

The Service does not intend to create a state where obscene materials are publicly displayed or generally viewable in Japan.

Users accessing the Service from Japan shall, at their own responsibility, take maximum care to ensure that viewing such expressions does not exceed what is permitted under Japanese law.

3. User Responsibility for Self-Verification

Users located in Japan are responsible for viewing and using content on the Service based on their own intent and judgment.

The Service does not actively provide adult content specifically targeted to Japan.

4. Violations of the Addendum

If conduct violating this addendum is identified, the operator may, without prior notice, suspend use, block access, or delete accounts.
